Welcome to Image Chat (the "Service"). These Terms of Service ("Terms") constitute a legal agreement between you and Image Chat ("we," "our," or "us"). By accessing or using the Service, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Image Chat provides an AI-powered image chat service that allows users to:

• Upload images
• Ask questions about images to AI
• Receive AI-generated responses
• Engage in multi-turn conversations

AI Models Disclosure: Image Chat uses OpenAI vision models. Fast model is powered by OpenAI GPT-4o-mini (free), Advanced model is powered by OpenAI GPT-4o (10 credits), and Premium model is powered by OpenAI GPT-5.5 (25 credits). All AI services are provided by OpenAI.

Service Limitations: Service is for personal and non-commercial use only. Unregistered users may use the free Fast model up to 30 times per IP address. After reaching this limit, you must sign in to continue using the Service. We reserve the right to modify, suspend, or discontinue the Service at any time.

3. Account Registration

3.1 Registration Requirements

• You must be at least 13 years old to use the Service
• You need to create an account via Google OAuth
• You agree to provide accurate and complete information

3.2 Account Security

• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• Please notify us immediately of any unauthorized use

4. Acceptable Use

4.1 You Agree Not To:

• Upload illegal, harmful, fraudulent, or infringing content
• Upload content involving child sexual abuse (CSAM)
• Upload unauthorized private images
• Attempt to bypass security measures
• Use automated tools to abuse the Service
• Reverse engineer, decompile, or disassemble any part of the Service

4.2 Content Restrictions

Prohibited Content: CSAM, NCII, all NSFW content (nudity, pornography, adult-oriented), extreme violence, hate speech, IP-infringing content.

Consequences: Content removal, account suspension/termination, reports to law enforcement if applicable.

5. Intellectual Property

5.1 Your Content

• You retain ownership of uploaded images
• You grant us a limited license to process images and provide the Service
• We do not claim ownership of your content

5.2 Our Content

The Service, website, logo, and brand are our intellectual property. Unauthorized use, reproduction, or distribution is prohibited.

6. Subscriptions and Payments

6.1 Pricing

Current pricing is available on our Pricing Page. We reserve the right to change prices at any time.

6.2 Payment

• We accept Creem (Credit/Debit cards, Apple Pay, Google Pay)
• Payment is securely processed by Creem
• We do not store your complete payment information

6.3 Credit System

6.4 Credit Usage Rules

• Fast (OpenAI GPT-4o-mini): Free (no credit consumption)
• Advanced (OpenAI GPT-4o): 10 credits per use
• Premium (OpenAI GPT-5.5): 25 credits per use
• Monthly subscription credits: Reset at billing date, do not roll over
• Purchased credit packages: Never expire

6.5 Free Tier Limitations

• Fast: Available without login up to 30 uses per IP address; sign-in is required after the unregistered-use limit is reached
• Advanced: Requires login to use (uses monthly 300 credit allocation)
• Premium: Not available for Free tier

6.6 Refund Policy

• Within 7 days: Full refund available for unused subscriptions
• After 7 days: No refunds for unused subscriptions or credits
• Credit packages: No refunds once purchased

7. Disclaimers

• The Service is provided "as is" without warranties
• AI-generated content does not constitute professional advice
• We are not liable for indirect, incidental, or consequential damages
• Maximum liability is limited to fees paid in the past 12 months

8. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved in the courts of Delaware.
